These Terms of Sale govern your order and purchase merchandise or services on this site offered by Club of Style Hongkong Ltd. (the “Company”).
The Terms of Use of this website and of its features are governed by its terms of use and are incorporated herein by reference to the extent not modified hereby. Your use of this website constitutes your agreement to comply with and be bound by the rules set forth therein and we ask that you indicate your agreement as provided for.
B2B CUSTOMERS
All Terms of Sale, specifically the right of return, cancellation, and warranty referred to in the following general Terms of Sale, apply to goods sold through the website and its checkout function provided by fashion4home including telephone orders made through the secure payment provider. B2B customers and orders made outside of the normal checkout process will be subject to specific Terms of Sale to be agreed upon between Club of Style Hong Kong, their U.S. agents, fashion4home, Inc., and the customer.
REGISTRATION
You can register to be able to order merchandise and services from this site. Registration to this site is free. Please follow the instructions.
By registering to this site, you expressly agree to the Terms of Sale and the Terms of Use of this site.
You are not permitted to order or purchase on this site if you do not agree to the Terms of Sale or the Terms of Use of this site.
Customers may also register to vote on new designs for products, and provide comments on product designs and sketches.
PAYMENT
Prices indicated are in U.S. Dollars. Payment is due at the time of placing an order. We accept credit card payments (Visa, MasterCard, American Express).
Payment is done via a payment service provider’s website and payment data of any credit card information will not be stored nor forwarded.
SHIPPING AND HANDLING
Logistics and shipping costs refer to shipping via parcel service or freight forwarding service. Shipping costs referred to on the website indicate a standard delivery to anywhere within the contiguous U.S. Standard delivery refers to a garage or first dry room delivery. It does not include carrying up stairs, removal of packaging or assembly. You may request and book white-glove service for an extra fee. Please contact customer service for such extra service.

All customer service is done either via service-chat, e-mail or telephone (Monday-Friday 9:00 a.m. – 9:00 p.m. EST).
TAX, DUTIES & TRANSACTION FEES
Prices do not include taxes, duties or other governmental charges or transaction fees for imposed by credit card companies.
You warrant to Company that your order conforms to all applicable local and international laws, regulations and rules, including without limitation, tax laws, custom duties, import/export (or re-import/export) controls, and you are solely responsible for all applicable taxes and custom duties assessed on your orders, by the destination authority or other applicable authorities within or without the United States.
TRACKING ORDER
You can track your order using the tracking number sent to you in an e-mail when your order arrives at the central distribution point. You can also track your order history and status in My Account.
OTHER FEATURES
Other features on this site, such as the Shopping Cart and My Account, are offered to assist and enhance your shopping convenience on this site. However, no assurance is given as to the accuracy, effectiveness or fitness for your personal needs of these features.
CANCELLATIONS
Please note that all of our products are manufactured “on demand”. Once an order has been placed and production has begun, it is no longer possible to cancel such an order without incurring related expenses. If you wish to cancel an order, please contact our Customer Service Team within 48 hours of placing the order and a refund will be issued – excluding any cancellation fees - in the manner payment was made. Any orders canceled with our Customer Service Team more than 48 hours after the order was placed will be recognized and an administration fee of 10% of the original item price will apply.
30 DAYS FREE RETURN POLICY*
If you are not 100% satisfied with your purchase, you can return your order to our fulfillment center for a full refund of the purchase price and the shipping and handling charges originally paid. We believe that in order to have the best possible online shopping experience, our customers should not have to pay for domestic return shipping. So if for whatever reason you are not happy with your purchase, contact our Customer Service Team who will guide you through the return process.
With fashion4home, Inc.'s 30 days FREE Return Policy, there are no special catches or exceptions. All we ask is that you:
-Make sure that the returned merchandise is in the original condition (unused, unaltered, all sew-in labels attached, and not damaged).
-Send the merchandise back to us in the original packaging (or similar quality packaging).
-Inform our Customer Service Department within 30 days of delivery to return the item.
If you meet the three requirements mentioned above (original product condition, adequate packaging quality and timely notification) you will receive full refund of the purchase price and the shipping and handling charges originally paid.
NOTE: If your return does not meet any of the latter two requirements, standard shipping fees (original shipping & handling fees, return shipping fees) and restocking fees (10% of purchase price) will be deducted from your refund. If the product returned is not in its original condition, we will not be able to refund you the purchase price and other charges – you are then free to pick up the returned item again at our warehouse at your own cost.
Returns with FASHION FOR HOME <
-Return shipping is absolutely FREE if the merchandise is in the original condition and is returned in the original packaging (or similar quality packaging).
-You can return your purchase for up to 30 days from the delivery date. Simply inform our Customer Service Team by e-mail or regular mail within 30 days to be eligible for the FREE return.
-In case of parcel deliveries, you will be provided with a pre-paid FedEx domestic label to return the purchase to us. In case of deliveries fulfilled by our logistics partner, our Customer Service Team will notify our logistics partner that will arrange for a pickup appointment with you.
-Once your return is received and inspected by the fulfillment centers, usually within 72 hours of receipt, and the merchandise is deemed to be in the same original condition that your received it, your refund will be processed and a credit will be automatically applied to your credit card or original method of payment within 14 days. Please note that depending on your credit card company, it may take an additional 2-10 business days after your credit is applied for it to post to your account.
*The 30 days FREE Returns Policy is a limited time offer valid for purchases made on or after August 8, 2010. The offer applies only to merchandise shipped to and from addresses in the 48 contiguous U.S. states. This offer is subject to change without notice.
1 YEAR LIMITED WARRANTY
What Does The Warranty Cover?
fashion4home, Inc., as its sole obligation, will repair or replace (at its option) any product, part, or component covered by this warranty which fails under normal use as a result of a defect in material or workmanship; fashion4home, Inc. will repair or replace the aforementioned product, part, or component with a comparable product, part or component.
What Does The Warranty Not Cover?
fashion4home, Inc. does not warrant:
- Damage, marking, or staining of veneer surfaces due to contact with rubber or similar compounds; damage from sharp objects or imprinting from writing instruments, or prolonged exposure to moisture or direct sunlight
- Products that have been stored or assembled incorrectly, used inappropriately, abused, misused, altered
or cleaned with wrong cleaning methods or wrong cleaning products
- Normal wear and tear, cuts or scratches, or damage caused by impact or accidents
- Natural variations in wood grain or figure or the presence of character marks
- Changes in surface finishes due to aging or exposure to light
- Marks, scars, or wrinkles occurring naturally in leather
- The matching of colors, grains, or textures of natural materials
- The colorfastness or the matching of colors of textiles, including an exact match to cuttings or to swatch
Also, consequential and incidental damages are not recoverable under this warranty. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
What Is The Period Of Coverage?
The warranty lasts for one year after the date of delivery. Coverage terminates if you sell or otherwise transfer the purchased item.
This warranty is provided to you in lieu of all other express or implied warranties including warranties of merchantability and fitness
for the merchandise and related services offered for sale, which are disclaimed hereunder. However, if such warranties are required as a matter of law, then they are limited in duration to the warranty period.
How Do You Get Service?
Simply notify our Customer Service Department by e-mail or regular mail to start your claim. A
claims specialist will then guide you through the claims process. As part of the claims process, you will need to provide written and
picture evidence that shows the defect of the product, part, or component covered by this warranty.
How Does State Law Apply?
This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
LIMITATION OF LIABILITY
IN NO EVENT SHALL COMPANY NOR ITS THIRD PARTY VENDORS BE LIABLE TO YOU FOR ANY DIRECT (EXCEEDING THE MONIES PAID BY YOU TO COMPANY), INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, TANGIBLE OR INTANGIBLE DAMAGES YOU MAY INCUR IN CONNECTION WITH YOUR ORDER AND PURCHASE OF PRODUCTS OR SERVICES OFFERED HEREBY, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOST REVENUE, LOST PROFITS, BUSINESS INTERRUPTION, LOST INFORMATION OR DATA, COMPUTER INTERRUPTION, COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, LOSS AND DAMAGES RESULTED FROM CLAIM BY A THIRD PARTY, EVEN IF COMPANY SHALL HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES, AND WHETHER OR NOT THE CIRCUMSTANCES GIVING RISE TO SUCH CAUSE MAY HAVE BEEN WITHIN THE CONTROL OF COMPANY.
GOVERNING LAW AND JURISDICTION
You agree that your purchase and the construction of this Terms of Sale are governed by the laws of the State of Delaware without regard to its conflict of law principles, and the United Nations Convention on Contracts for the International Sale of Goods does not apply.
You consent to the jurisdiction of the federal and state courts in the State of Delaware, United States with respect to enforce the arbitration provision hereof, and you waive any claim of lack of jurisdiction, improper venue or inconvenient forum.
ARBITRATION
You agree that any controversy or claim relating your purchase of merchandise or related services on this site, shall be resolved exclusively by final and binding arbitration under the rules of the American Arbitration Association then in effect, in its offices in New York, New York of the United States. The language of the arbitration shall be English. Judgment upon the arbitration award may be entered in any court having jurisdiction.
SEVERABILITY
Should any provision(s) herein be determined to be invalid or unenforceable pursuant to applicable law by a competent authority with jurisdiction, a valid and enforceable construction that is most close to the original commercial intent expressed thereby shall be given to and supersede such provision(s), while the balance hereof shall remain in full effect.
ENTIRE AGREEMENT
By ordering or purchasing on this site, you agree that the terms and conditions contained and referenced herein represent the entire understanding between Company and you with respect to your order and purchase on this site, and supersede any prior or contemporaneous, conflicting or additional understanding or communications, unless otherwise agreed by parties in writing and signed by Company.
